Attorneys with diverse and extensive knowledge of the many issues that arise when defendants seek to have a joint defense agreement will present “Joint Defense Issues: Privileges, Agreements, and Practical & Ethical Problems” from 6 – 8 pm on Wednesday, January 18, 2012, at Rutgers School of Law–Newark. The program is sponsored by the Heckel Inn of Court at Rutgers School of Law– Newark and the Rutgers Institute for Professional Education, a partnership between the Rutgers law schools in Newark and Camden.
Issues to be addressed include: What should go into an agreement; What restrictions exist for a company paying defense costs; What happens when joint defense agreements blow up, such as when a participant wants to share all with prosecutors.
Speakers are former New Jersey Supreme Court Justice Roberto Rivera-Soto, author of In Re: Grand Jury, the definitive opinion on joint defense issues surrounding the payment of legal fees for targets/witnesses by corporate targets; U.S. Attorney Paul Fishman, who has expertise in agreements from both the prosecution and defense side; Samuel Moulthrop, experienced with joint defense issues in civil and criminal practice on behalf of the management of major corporations; and Justin Walder, dean of the New Jersey criminal defense bar who specializes in white-collar criminal defense and complex corporate and commercial litigation.
